IMPORTANT INFORMATION ABOUT THESE TERMS
When you complete your Booking, you accept these Terms and Conditions (“Terms”) and any other terms and conditions that you are provided during the booking process. These Terms include an agreement to mandatory binding individual arbitration, which means that you agree to proceed in court. These Terms also include your waiver of any right to bring or participate in, a class action and a jury trial waiver. If anything in these Terms is (or becomes) invalid or unenforceable, it will still be enforced to the fullest extent permitted by law and you will still be bound by everything else in these Terms. Definitions

“DP” means Discover Pakistan, a Budeel Group LLC company and its owners, operators, parents, subsidiaries, affiliates, principals, agents, licensors, joint venturers, ground service providers, and all employees, officers, pilots, crew members and agents of such individuals, companies, and entities. DP’s address is 9449 Briar Forest Dr. Apt 3510, Houston, TX 77063.

“Booking” means the Guest or Guest’s agent to enter into a Contract with the Company.

“Booking Terms and Conditions” or “Terms” means these terms and conditions and the information contained on Discover Pakistan’s website and/or other information that will form the express terms of your Contract with DP.

“Contract” means the contract between DP and the Guest(s) for the Tour Package as reflected in the confirmation invoice sent by DP to the Guest’s Travel Advisor or directly to the Guest.

“Tours” means those tours offered by DP including but not limited to Trekking Tours, Cultural & Heritage Tours, Family Tours, Special Interest Tours, Safaris, Day Tours, Extensions, Expeditions, Overland Journeys, Festivals, Tailor Made Tours, and all related/published Tours on DP’s website.

“Group Tours” means those journeys offered by DP including but not limited to Trekking Tours, Cultural & Heritage Tours, Family Tours, Special Interest Tours, Safaris, Day Tours, Extensions, Expeditions, Overland Journeys, Festivals, Tailor Made Tours, and all related/published tours on DP’s website.

“Guest(s)” means each person or a group of people, including minors, named either on the booking confirmation or on the invoices issued by DP.

“Guest with Disabilities” means any Guest with special needs.

“Minor” means any person under the age of 18.

“Refund” means a return of all or part of the fare paid and is applicable only on the conditions described herein. A Refund may, at DP’s sole option, be issued in the form of a travel credit which shall have no cash value.

“Travel Advisor” means any travel agent or any website not owned or operated by DP and used by the Guest to book their Tour Package.

“Tour Package” means the Journey whether or not in combination with any flights.

“Website” means the set of related web pages, documents, and hypertext links served from the web domain www.abercrombiekent.com.

1. DEPOSIT AND PAYMENT
A deposit is required to confirm a reservation that shall be determined at the time of booking. For reservations confirmed in U.S. Dollars, final payment in the form of a check or all major credit cards must be received on the date determined at the time of booking. If applicable, please contact your Travel Advisor for complete details. Failure to strictly comply with the deposit and final payment schedules, or any other applicable policies and procedures, will result in the automatic cancellation of pending reservations.

If your reservation is made inside of the final payment window, the entire cost of the trip must be paid at the time of the request in order to secure confirmation.

For Tailor Made journeys, additional deposits may be required for planes, vessels, and trains, including private charters; select accommodations as noted in your proposal; exclusive private use of accommodations or venues; groups of 10 or more; or itineraries that fall over holiday or festival seasons.

An additional nonrefundable permit fee is required at the time of booking for where applicable including mountaineering expeditions and trekking tours.

2. GUARANTEED DEPARTURES
All group tours except for mountaineering expeditions and some trekking trips are guaranteed to operate with a minimum of two (3) persons unless noted on the itinerary. Guaranteed departures will operate except only in cases of force majeure, which could include any major world event adversely affecting international travel patterns or other circumstances beyond DP’s control.

3. THE PRICE ASSURANCE
DP will honor any lower advertised price on the Website for the same program, travel date, and accommodation classification for all tours available through DP excluding mountaineering expeditions and trekking tours, international and internal air, and extra services. The Travel Advisor or travelers must contact DP for a price adjustment prior to travel. DP reserves the right to modify or cancel the DP Price Assurance for future bookings without prior notice.

4. INCLUDED IN ALL TOURS
All accommodations, meals, and fully guided sightseeing as noted in the itinerary; park and entrance fees; coffee/tea/soft drinks/water at included meals; local bottled water during sightseeing; porterage of up to two (2) pieces of baggage per person; complimentary Internet access where available at land accommodations excluding mountaineering expeditions, trekking trips, and/or in the wilderness where internet service is not guaranteed.

Additional Services:

Any additional services not offered in the packages, if required by customer(s) shall be requested in advance 90 days before departure. DP shall try level best to provide, however, it cannot be guaranteed and is subject availability of the extra/additional service(s) requested. 

Airport Transfers:
Private airport transfers regardless of the day of arrival and departure shall be provided by DP’s local service providers for each trip/tour/service booked through DP, USA.

5. NOT INCLUDED IN JOURNEYS
International and internal airfares, unless otherwise noted; costs associated with obtaining passports or entry visas; reciprocity and other border fees; airport departure taxes, unless otherwise noted; excess baggage charges; gratuities to the tour guides, drivers, cooks, assistant cooks, and porters; meals other than those specified in the itinerary; room service; beverages other than those noted in inclusions above or specified in the itinerary; sightseeing not included in the published itinerary; and personal expenses such as laundry, communication charges, Internet access; and optional activities (which are subject to availability).

6. HOTEL CHECK-IN
Most hotels allow check-in to take place during the midafternoon. Should you wish to have a guaranteed room ready for your immediate check-in upon arrival, it requires an additional room night to be confirmed. Please ask DP for details and prices. Requests for early check-in based on hotel availability cannot be guaranteed and are at the sole discretion of the hotel.

7. ROOM UPGRADES
Upgrades are typically available on request at individual hotels for an additional cost. Please ask DP for details and prices. Specific requests such as adjacent rooms, bedding requests, and smoking rooms. 

8. SPECIAL DIETARY REQUESTS
Special dietary needs should be advised at the time of booking. Please note that reasonable efforts will be made to secure special requests; however, they cannot be guaranteed.

9. ITINERARIES
DP reserves the right to modify itineraries, including arranged sightseeing and substitute accommodations, including vehicles, air ticket class, and trains, at any time due to unforeseen circumstances or circumstances beyond DP’s control. Reasonable efforts will be made to operate itineraries as planned, but alterations may occur after the final itinerary has been issued.

Due to the nature of local political, geographical, climatical, and security reasons, itineraries are for guidance purposes only and may be changed or rerouted due to unforeseen circumstances including but not limited to weather, wildlife, ice, mechanical and other malfunctions, medical emergencies and other conditions beyond DP’s control at the sole discretion of the guide, local operator in consultation with guest(s).

10. AIR TRANSPORTATION
International airfare to and from starting point and ending points is not included in program pricing, however, if requested by the guest, DP may arrange special airfare through one of the partner agents depending on the availability of the seat(s), the costs of such arrangements shall be communicated to the guest by one of DP Travel Advisors and must be paid in full by guest(s) at before purchase of the air ticket(s). All internal air is based on economy class seating and is 100% non-refundable at the time of final payment (some exceptions may apply). All international and internal air quotes are subject to change until the final payment has been received by DP. Flight confirmation is based on availability. Air reservations cannot be confirmed until a passport copy is received by DP or DP’s partner agents.

Air carriers/airlines are independent contractors or companies not owned, managed, or operated by DP. For any refunds for tickets purchased through DP partner agents, DP or its partners shall not be liable and do not assume responsibility and accept claims. In case of seat upgradation, name change, changes in schedule, flight cancellation, or insufficient travel documentation. Should you change or cancel your air transportation arrangements before or after your travel begins, all airline change and cancellation fees will apply.

Please check with your international carrier for other baggage restrictions and fees applicable to your international flights

11. BAGGAGE
DP provides porterage of up to two (2) pieces of baggage per person. Please note: Should your journey include internal/domestic or charter flights, your luggage allowance may be less than two (2) pieces of baggage, and weight/size restrictions and additional costs may apply.

Details will be provided in your Pre-Travel Documentation. Baggage and personal effects are at the owner’s risk throughout the travel program, and DP assumes no liability for lost, stolen, or damaged baggage, however, in case of insurance claims, DP’s local service provider shall help guest(s) with police reporting and documentation.

12. PRICES AND ARRANGEMENTS
All prices are per person based on two persons sharing a room or tent, or hut, unless otherwise a single supplement is purchased, prices are quoted in U.S. dollars, and are subject to change prior to booking a tour. A detailed list of services included and excluded in the given price is set forth in the itinerary. Any items not specifically mentioned are not included in the Tour price.

Once your deposit is received and the signed Travel Agreement is received by DP, your Tour price is guaranteed. Any changes to the price before a deposit and Travel Agreement is received, Guests will be notified of the changes. In case of a price increase by local ground handlers/service providers, after the deposit and Travel Agreement are received, Guests will not be charged any additional fees. Single accommodations are subject to a single supplement and subject to availability based on the type of Tour and time of booking.

DP is under no obligation to give a breakdown of the costs of any tours. Pre- and post-Tour Extensions are only available to guests booked on related tours. Modification of program content to accommodate a smaller group size will not affect the published program price. Any modifications to a Tailor Made itinerary, including dates or the number of people traveling, will require a revised proposal. 

13. DEPOSIT AMOUNTS: A per-person deposit is required to confirm a booking. For booking made within the timeframe between the Final Payment Date (as defined below) and departure, you must pay 100% of the Tour price, but your reservation will remain fully refundable for up to 48 hours (the “Hold Period”) to allow you time to review the Travel Agreement.

4. CHILD POLICY
All children under the age of 18 must be accompanied by an adult. Guest(s) are to inform DP 60 in advance if the group size on family tours, tailor-made tours, and private tours changes in order to accommodate additional members. Note that some accommodations require that children below a certain age share a room with an adult.

The parent or guardian traveling alone with a child is expected to carry documentation(s) that proves their relationship to the child (e.g., birth certificate) and evidence that they have permission to travel with the child (e.g., consent letter). Guests traveling with children who are not related are recommended to carry documentation that provides evidence they have permission to travel with the child. Guest(s) are advised to check with the appropriate government authority to determine the necessary documents required for travel with children. DP cannot be held responsible or asked for refunds should the guest, child, or any member of the traveling party be denied entry to a country due to non-compliance with a country’s requirements.

15. HEALTH, FITNESS, AND EXPERIENCE
By booking your Tour, you certify that you and all other members of your traveling party: (i) have carefully read the details of the itinerary and selected an itinerary that is appropriate for each person’s abilities; (ii) do not have any impairment or disability which might present a safety risk during the Tour or any of the Activities; (iii) have consulted with a personal physician as appropriate; and (iv) will immediately advise DP if you or anyone in your travel group is unable to meet the safety requirements that are necessary for the safe operation of the Tour or Activity. If your circumstances change between the date of booking and the Tour departure, you must inform us as soon as possible and advise us of any special requests and requirements that need to be accommodated.

Fitness levels according to the nature of each Tour are clearly defined in the itinerary, for mountaineer expeditions and demanding trekking programs require prior experience and a great fitness level. To enjoy, as intended, please follow and make sure your fitness and experience level are as per the demand of the tour booked. If a Guest has any pre-health-related condition(s), please consult with your personal physician if you can undertake the tour. By booking the tour, Guest consent that they are fit and have adequate experience as per the requirement of the Tour and DP shall not be held responsible for any fitness, experience, health, and or altitude-related circumstances if arise any. 

16. RIGHT TO TERMINATE

DP reserves the right to immediately terminate any Tour or Activity if the Guest(s) is disruptive or otherwise adversely impacts the experience for others, 

DP reserves the right to cancel, terminate, discontinue, or modify any reservations, Tour, or Activity if the Guest(s) cannot meet the safety requirements that are necessary for safe operation or fails to obey signage, instructions, protocols, or rules without any refund to the Guest(s).

17. COVID-19 VACCINATION REQUIREMENT
All Guests must be fully vaccinated for COVID-19 and present proof of vaccination during travel on all Tours prior to departing in accordance with the local laws of Pakistan and the air carrier you and your group or family are flying with.

17. INSURANCES
Travel insurance is not included in the price of the tour being booked or booked but is strongly recommended. Travel insurance is available through multiple independent travel insurance providers. Travel insurance typically provides coverage for tour cancellation and interruption, baggage protection and delay, travel accidents and delay emergency medical and dental services, and certain associated transportation. If you do not purchase travel insurance, you are responsible for any medical expenses, any medical evacuation costs, and any other costs arising during your travel.

18. PASSPORTS AND VISAS
The Traveler is responsible for ensuring that all necessary travel documents, including passports, visas, and any other required permits, are valid and obtained prior to the departure date. DP shall not be liable for any consequences arising from the Guest’s failure to obtain the required travel documents.

19. CANCELLATION AND CANCELLATION CHARGES
All cancellations shall be communicated to DP in writing through email, cancellation charges will be effective and cancellation fees shall be charged subject to the following days prior to the departure date. Cancellation of additional hotel nights and other extra services booked in connection with DP Tour are subject to specific cancellation penalties.

Changes And Modifications In Itinerary
Guests will be responsible for any changes or cancellations made to the itinerary at their request or beyond their control, before or during travel, including expenses incurred due to a change, delay, or cancellation of any flights.

Partial Room Cancellation
If a Guest cancels or leaves a Group Journey and a traveler remains, an additional supplement may apply to the price for the remaining Guest.

Cancellation Charges For Internal Air
All internal air is 100% non-refundable at the time of final payment (some exceptions may apply).

20. FORCE MAJEURE
Force majeure means unusual and unforeseeable circumstances beyond DP’s control or the control of our suppliers, the consequence of which neither DP, nor its suppliers, could avoid even with all due care, including, but not limited to, war or threat of war; riot; civil strife; terrorist activity (actual or threatened); industrial dispute; technical problems with transport, machinery or equipment; outages or power failures; natural or nuclear disaster; fire, flood, drought or adverse weather conditions; pandemics, epidemics or outbreaks of illness. In the event of a cancellation or material alteration to the Tour as a result of the circumstances as described in this clause, DP shall have no liability whatsoever for any travel-related costs incurred by the Guest, including but not limited to air, insurance, visas and other travel arrangements of any kind.

21. PHOTOGRAPHY AND VIDEOGRAPHY OF GUEST(S)
DP reserves the right to take photographs and video of Guests during the operation of any Tour to use, re-use, publish, and republish their image or video, or video clip and interview for promotional purposes during the program and thereafter. By booking a Tour with DP, Guests acknowledge that DP is the owner of the photographs and video and agree to allow their Image to be used in such photographs and videos, which may thereafter be used by DP for promotional purposes only. Guests who prefer that their images, videos, or interviews not be used must inform their tour guide at the beginning or during their Tour; and notify DP by email, not later than thirty (30) days following the end of the Tour. In the event the Guest fails to comply with both obligations, the Guest shall not be exempt from this section. If such written notice is not timely provided, the Guests, individually and on behalf of any Minor traveling with them, have granted unrestricted rights and permission for DP to use the Images.

22. AMENDMENTS
Despite DP’s efforts to provide accurate information about the Tour, some information may be changed due to changes in the Tour program, DP reserves the right to correct any errors or omissions in its published materials and to amend these Terms at any time. All amended information shall be communicated to Guests prior to and after departure or during the operation of the Tour.  Terms shall automatically be effective upon being posted by DP to the Website. 

23. IMPORTANT LIMITATIONS ON THE COMPANY’S LIABILITY
Nothing in these Terms shall limit or deprive DP of the benefit of any applicable statutes or laws of the United States of America or any other country; or any international convention providing for release from, or limitation of, liability. In the event multiple statutes, laws or conventions may apply, DP shall be entitled to any or all such limitations unless there is a conflict between such statutes, laws, or conventions, in which case DP shall be entitled to invoke the limitation which provides the most favorable limitation to DP.

(A) Time Limits For Claims
DP shall not be liable for any claims whatsoever unless full particulars in writing are given to DP within thirty (30) days after the Guest completes the Tour. Legal proceedings to recover on any claim whatsoever other than for personal injury, illness or death shall not be maintainable unless commenced within six (3) months after the date Guest completes the tour, and unless served upon DP within 90 days after commencement. Guest expressly waives all other potentially applicable state or federal limitation periods for claims which include, but are not limited to, allegations concerning any and all civil rights, the Americans with Disabilities Act (ADA), trade practices, and/or advertising.

(B) Claims for Emotional Distress
DP shall not be liable to the Guest for any emotional distress, mental anguish, or psychological injury of any kind, except where said emotional distress, mental anguish, or psychological injury was the result of either (a) physical injury to the Guest caused by the negligence or fault of DP and or it’s local ground service providers or (b) the Guest having been at actual risk of physical injury and such risk was caused by the negligence or fault of DP and or it’s local ground service providers.

(C) Claims of Improper Performance or Breach of the Contract
DP’s liability for improper performance or breach of the Contract shall be limited to a maximum of the price which the Guest paid for their Tour Package.

(D) No Consequential, Indirect, or Punitive Damages
Notwithstanding anything to the contrary elsewhere in these Terms, in no event shall DP or its employees, partners, directors, officers, managers, agents, or local ground service providers be liable for any indirect, consequential, incidental, or punitive damages (including but not limited to damages for lost profits, loss of revenue, loss of use, loss of contract or another opportunity, for any other consequential or indirect loss or damage of a similar nature) arising out of the transaction contemplated herein.
